1. Agreement to these Terms
By creating an account, accessing OCG Max, or using our APIs and related services, you agree to these Terms and our Privacy Policy. If you use OCG Max for an organisation, you confirm that you have authority to bind that organisation.
2. Accounts and access
You must provide accurate registration information and keep your sign-in credentials confidential. You are responsible for activity carried out through your account, including the actions of team members, applications, and API credentials that you authorise.
3. Platform services
OCG Max may provide access to SMS, RCS, voice, WhatsApp, email, related APIs, routing tools, delivery events, and support services. Channel availability, sender requirements, delivery behaviour, and destination coverage may vary by market, carrier, provider, and use case.
4. Your communications
You are responsible for the recipients, content, timing, sender identity, and legal basis for every communication you initiate. You must maintain all notices, consents, opt-out mechanisms, and records required by applicable law and industry rules.
5. Acceptable use
You must not use OCG Max for unlawful, deceptive, harmful, abusive, or unsolicited communication; to impersonate another person or organisation; to distribute malware; to interfere with networks or platform security; or to evade channel, carrier, or regulatory controls.
6. Suspension and protection measures
We may limit, reject, or suspend traffic or account access when reasonably necessary to protect recipients, networks, our platform, or other customers; to investigate suspected misuse; to comply with law or provider requirements; or to address an immediate security risk.
7. Charges and taxes
Paid services, usage rates, minimum commitments, taxes, and billing terms will be set out in the applicable order, quotation, or account interface. You are responsible for charges generated by your account and for taxes that apply to your purchase, excluding taxes on our income.
8. Intellectual property
We and our licensors retain all rights in OCG Max, including its software, APIs, documentation, design, and trademarks. You retain rights in content you submit. You grant us the limited rights needed to process that content and provide the services.
9. Service changes and availability
We may improve, modify, or discontinue platform features. Communications depend on third-party networks and providers, so delivery times and successful delivery cannot be guaranteed. We will use reasonable care in operating the services.
10. Confidentiality and data
Each party must protect the other party's confidential information and use it only for the relationship. Our handling of personal data is described in the Privacy Policy and, where applicable, a separate data processing agreement.
11. Liability
Nothing in these Terms excludes liability that cannot legally be excluded. To the extent permitted by law, neither party is liable for indirect or consequential loss. Any additional limits or remedies agreed in an order or written enterprise agreement will apply to that relationship.
12. Ending the service
You may stop using OCG Max at any time, subject to outstanding payment or contractual commitments. We may terminate access for a material breach, unlawful use, unresolved security risk, or as otherwise permitted by an applicable agreement.
